Fraud cases

Are you suspected of fraud?

Anne Marie de Koning has a particular interest in fraud cases. If you are suspected of fraud, you may be arrested and questioned. Even after that, the authorities may want to keep you in custody for longer. Anne Marie will then assist you with vigour and will do everything she can to secure your release.

As a fraud defence lawyer, Anne Marie de Koning can provide legal advice and represent you in criminal proceedings. She has achieved excellent results in fraud cases such as tax fraud, personal care budget (PGB) fraud and bankruptcy fraud. With her expert help, she offers a way forward by preparing and shaping your defence together with you. If an acquittal is not achievable, Anne Marie will secure the best possible outcome in your case.

The other lawyers at SKE Advocaten also regularly assist in fraud cases, such as bankruptcy fraud, tax fraud, insurance fraud and PGB fraud, and are therefore well placed to assist you in your criminal case. Where necessary, we also do so on a legal aid basis.

Fraud

What types of fraud cases do we handle? Common types of fraud include benefit fraud and social assistance fraud, tax fraud (for example a VAT carousel), bankruptcy fraud, deception, computer fraud, mortgage fraud, insurance fraud and, much in the news at present, PGB fraud. We also specialise in topical fraud cases such as sports fraud (doping, match-fixing) and fraud involving Bitcoin. The Public Prosecution Service often also brings money laundering charges where there has been an attempt to conceal the criminal origin of money. We know better than anyone how to respond to that.

Have I committed fraud?

That question is not easy to answer, but some general guidelines can be given. If you acted intentionally and gave a misleading picture of the facts in order to obtain a financial advantage, this may amount to fraud if you acted unlawfully. In doubt? Feel free to call Anne Marie de Koning or one of our other lawyers.

What sentence can I expect?

There is no standard sentence. Every case and every person is different. The criminal court assesses each case on the seriousness of the offences and takes the person of the suspect into account. We do, however, see a trend towards increasingly severe punishment for fraud. Prison sentences are now imposed with some regularity, where a few years ago a community service order combined with a suspended prison sentence would have sufficed. Because the stakes are high, we always advise you to contact one of our lawyers before responding to a summons from the police or the Public Prosecution Service.
